When your weapon is taken they will shoot a test round from your weapon, and match that round to the rounds taken as eveidence. With a FMJ you run more of a risk of the round passing through a subject or other medium, and injuring those who are not involved, then a hollow point round.
The key to a shooting situation is stopping a threat as quickly as possible. FMJ rounds have less chance of stopping a threat then HP rounds. That is why law enforcement agencies do not use FMJ round as duty ammunition. To many risks to the public, and officer.
You would be better off talking to your local law enforcement agency then to a defense attorney. If a defense attorney is telling you this then he is setting you up to be their client in a criminal and civil matter.
perhaps it's different in ca but in the phoenix metro area, there have been many shootings of intruders/burglars/victim of assault, reported by the news....... by homeowners that are assessed by l e in less than 24 hours, as good shoots & no charges to be filed.

This. Also, if you are ever in a situation where you need to shoot, you are shooting to stop the threat. Not to kill, not to injure, just to stop the threat. Having 10 rounds glide through the guy as he continues to do what ever he was doing to justify getting shot doesn't seem like the best way to stop the threat.

With FMJ's you increase liability, increase the chance of you being injuried, but if it is your choice so be it. I really wonder about that attorney and their experience, because if he did make that comment, I wonder if he'd stand behind it in court. Especially if there is a pass through shooting and another person is injuried. Sounds to me like this attorney is giving you very bad advise.
You need to research rounds, and stopping a threat. If all you are going to do is go to the range and practice, then FMJ's are great rounds.

Generally that's the same here, get that odd case once in a while that may take longer.
