I haven't heard anyone suggest taking anything away, just limiting or banning. They know there is no way to account for all the magazines out there. I'm in California with the 10 round limit. I carry a P229R or P226R in .40 caliber, and I'm not worried about two fewer rounds in the magazine.

A restriction on high-cap mags will probably have to pass Congress. It is not one of the measures he is expected to attempt by Executive Order.

But who the hell knows. We'll find out some more specifics tomorrow.

If I understood the Constitutional Lawyer that was interviewed on the radio the other day correctly, they cannot take away something that is already owned by a lawful gun owner. He cited the amendment number, but I can't remember it at the moment. It was another amendment other than the 2nd.
He basically said that any ban, if passed, would have to ban future manufacture.
I looked for a recorded version of the interview, but was unable to find. The Lawyer's name was Gerald Treese. He is also a Dean at a Texas college.

Sounds like if in New York, you're already porked. Elsewhere, we wait and see. And lobby like all get out.

It should not affect any existing magazines.

Depends on the state you live in, I guess. I bought my 229 .40 with 11 mag right before Clinton's mag restriction kicked in that subsequently expired.

We won't know until the final decision is made...
In California, we have had a 10 round capacity restriction. When that became law in California back in the mid-90's, I thought to myself, hey no big deal, I'll just carry an extra magazine and practice my speed reloads.

From what I understand of the NY law you may keep them but if you are involved in an event and the authorities can show you loaded more into the magazine than is legally allowed you are guilty of a misdemeanor.

If they take them away it would constitute unlawful confiscation

For the first year the law is in place, this is correct--you can have high-cap mags but you can't load more than 7 rounds.

After that first year though, high cap mags will be illegal to possess, regardless of how many rounds are actually in them.

Essentially, high-cap mag owners in NY are being given a 1 year grace period to get rid of them.

In my state the term civil disobedience comes to mind here. After all I doubt this type of crap would ever see the light of day in my home state.

I would expect almost immediate challenges to at least the mag issues in NY. The issue of making possession of currently legal mags illegal is a blatant violation of the ex post facto clauses of the US Constitution. I seriously doubt it will stand up in court and would expect it to be resolved long before the "grace" period. They can certainly ban sales and prohibit their use going forward - they cannot make them illegal to possess.

OK, O.K where they incarcerate a person for 10 years for smoking a joint. While taxpayers fund it... "You know what I am getting at" Folks fold like lawn chairs. They are so worried about their 'stuff' being taken away. Like a Mortgage. lol

Don't get me wrong I am not picking on you but you give folks in your neck of the woods a bit more credit then I think they deserve.

Considering you live in the Peoples Republic of Kommifornicate your doubt is common. Dope smokers and all druggies deserve whatever they get with no sympathy. 90% of all dope arrests include more serious charges. MJ arrests only are very rare. Now meth only charges are common and they deserve to be burned at the stake.

There is a HUGE difference between how we handle firearms issues and scum of the earth dopers. IN the PRK people might fold like lawn chairs but in middle America like OK/TX/KS/LA we are made of much sterner stuff than mostly spineless left coasters. No offense intended just facts.
