Reply from Louisiana State Senator on New Gun Laws

January 7, 2013

Dear Mr. Trahan:

My prayers and greatest sympathy go out to the families and community of Sandy Hook Elementary in Newtown, Connecticut, and to all families that have been affected by gun violence. On December 14, 2012, twenty-seven innocent lives were taken from us in a heartbreaking tragedy. As the nation grieves over this senseless act of violence, it is more important than ever that we come together to address the issues affecting American communities.

The Second Amendment to the Constitution guarantees the rights of all Americans to own and possess guns. While preserving the rights of honest gun collectors, sportsmen and owners who possess firearms for traditionally lawful purposes, we must also continue to ensure that we protect innocent unarmed citizens. I am sure you can agree - like any right guaranteed to a free people, the right to bear arms must be exercised responsibly.

Unfortunately, in the past year, we have seen instances where this right has been abused in tragic fashion. The theater shooting in Aurora, CO, the Sikh temple shooting in Oak Creek, WI, and the school shooting in Newtown, CT, were terrible and unnecessary tragedies. Occurrences such as these remind me of the important role that government plays in upholding statutes that aim to limit such tragedies.

We must do more to target the causes of mental illness and determine the most effective ways to treat it. I support and will continue to strongly advocate for expanded and improved mental health coverage so that the mentally ill can obtain adequate treatment to not only overcome their struggles, but to lead more productive and fulfilling lives.

I also support strict adherence of federally licensed firearms dealers to the requirements laid out in the National Instant Criminal Background Check System (NICS). The NICS determines the eligibility of an individual to purchase a firearm and explicitly prohibits those who have been legally determined to be mentally ill or committed to a mental institution from purchasing any weapons.

Currently, there is no gun control legislation scheduled for a vote. However, I believe that when evaluating future proposals, we must find a balanced way to address the safety of American citizens while ensuring Second Amendment rights granted under the Constitution. Please be assured that I value your input and will keep it in mind as we continue to address this issue in the 113th Congress.

I appreciate hearing from you on this matter, and I trust that you will continue to contact me on matters of mutual concern. Please feel free to visit my website at Mary Landrieu | U.S. Senator for Louisiana for more information on my legislative priorities.

With warm regards, I am
Sincerely,

I hate when they call these shootings an "abuse of our rights", or saying they don't support the "right" to commit a mass shooting. Nonsense. Crime has nothing to do with rights.

I also got a reply from Senator Durbin (Illinois), and he called an assault weapons ban "common sense".

He invited me to keep in touch, so I sent him a long reply split up into several sections, addressing each part of the issues I could think of. I think that any logical and reasonable person that read that email would then oppose gun control.

Let's hope Durbin is a reasonable man...

Here's a question though. I believe that there are very, VERY few "gun control" laws that should exist, and requiring a quick, computerized background check that should take no more than 15 minutes is one of them (unless of course one holds a permit to carry a weapon and has a check on file, then just running their ID to check or warrants should be necessary). Would any of you be opposed to that, and if so, why?

This is a form letter all the reps and senators are sending out . I recieved the very same from Castor in Fl.
Notice all of them talk about hunters and collectors, not one mentions the right to own to keep tyrany at bay. Not well worded, but go to the quotes of George Washington and Jefferson.
The hunter and collector bit is the reason to claim a magazine limit.
I also note they all claim there is no bill for them to vote on.DUH, ole Joe has not dropped the bomb his boss DIRECTED him to come up with.I wonder how ex. authority would fly.You can bet Obomi is looking at it.
Question, does the supreme court rule on these or is that a hands off?

Mary Landrieu is worthless. The way you can tell she's lying is when her lips are moving.

I've emailed her and gotten the same form email. From what I understand this was prepared by the DNC for all their people to send out. I can assure you, Mary Landrieu will go along with whatever Harry Reid tells her to. She may vote against the bill if they don't need her vote, but I can assure you she will support it if it comes down to needing her vote for it to pass.

I don't mind a background check for purchasing a weapon. I have nothing to hide. Except my weapons.

It's a shame they have these prepublished replys going out to everyone witing their senate. That tells me they don't even care what the individual has to say, but we already knew that. Guess they send spam mail out to everyone to make it look as if they actually read what the public thinks. Guess their minds are already made up!!

This country is hopelessly in debt. Added in with all the public and private pension plans that were never funded properly, and the fact that interest rates on the debt will eventually go up.
Those people in washington know that the jig will eventually be up, and it is completely in their best intrest to disarm us before the music stops.
They have simply been waiting for the right oppourtunity. They have plans in place.
We are in for the fight of our lives.

I received the same drivel form letter from her today. The republican senator Vitter has not responded at all, so I guess non-committal middle of the road is all we can hope for from LA. What makes me even more ****** is the response from the White House about the petition to deport Piers Morgan. BHO claims we need to support the first amendment.... Great awesome, good on ya prez, how about taking some of your own advice....

I talked to a Vitter staffer on the phone who assured me that Senator Vitter is opposed to any new gun control laws.

Deadduck, that's good news. I hope there is truth to that. Vitter has my support over the Landrieu, I was just hoping he or his staff would respond at some level. I will try to contact them by phone tomorrow.

I hope it's true too Steveaux. I have noticed in the past that it takes his office longer to reply to an email than it does Landrieu.

My beliefs may not be popular with some here, but, I feel there should be regulations regarding the sale of firearms, including:

- background & mental disability checks
- required to pass firearm training & safety classes before the purchase
- manual safety required on all firearms
- annual firearm registrations
- the transfer of ownership of any firearm needs to be registered at the time of transfer
- A policy where the seller of firearms has the right to refuse the sale to anyone (without impunity) who appears to be of questionable character or mind, regardless of clean background & mental disability checks
- All customers are required to speak the English language
